Narcotics Cases
Drug cases continue to be prosecuted vigorously by both State and Federal authorities. These charges include narcotics distribution, possession with intent to distribute and simple possession. Other penalty enhancements are offenses committed within 1000 feet of school property and mandatory prison sentences. And prosecutions do not end with "street" drugs like heroin, cocaine and marijuana. Designer drugs, such as ecstasy, as well as anabolic steroids, are often considered a serious violation.
Brian J. Neary approaches drug cases in several ways. Constitutional issues, such as search and seizure law, are reviewed to determine whether an individual's right have been violated. Further, the circumstances of the investigation, including the police use of confidential informants are reviewed. Additionally, police tactics, which may constitute entrapment, are examined.
At the same time, sentence alternatives are considered. Drug rehabilitation, as opposed to prison, are often the best avenue of representation. The advent of "drug court" throughout New Jersey's criminal justice system provides Brian J. Neary the chance to help the client dealing with both the legal and medical dilemma facing those who abuse drugs.
